Penny can sue for the dismissed case.
They can get away with manufacturing evidence there ..here in NZ though a few have been convicted.
No wonder political lawyers like Bragg and James behave puffed up.

He can sue all he wants. But Prosecutors have absolute immunity for their acts as Prosecutor. So it's a complete waste of time and money. There have been far more egregious acts by other Prosecutors that have failed to proceed for this exact reason.

Dismissal in this case is one more time novel law produced by a lib prejudiced judiciary;

The defense had opposed the last-minute charge swap, arguing it presented a violation of state laws and could encourage a precedent where prosecutors overcharge from the start, knowing they can downgrade charges later on the fly if their case doesn't stand up. "The risk here of a coercive verdict or a compromised verdict…New York is clear that compromised verdicts are discouraged," Penny's lawyers told the judge. "It would force them into what we would submit would be manufactured, as to the lesser count of criminal negligence."

Judge comment to jury...have go at it (paraphrased) desperate attempt to send him to prison.

I think the problem obviously is that apparently no half way moral judge presides within NY where Penny gets a fair hearing.
