  1. A national security crisis is to be declared.
  2. Permanent border controls are to be instated.
  3. Anyone trying to cross the border in an irregular fashion will be pushed back even if said person is eligible for asylum.
  4. Anyone whose plea for asylum has been denied or who has been court-ordered to leave the country is to be taken into pre-removal custody without delay.
  5. The Federal Police may take illegal aliens into custody without an arrest warrant.
  6. Foreigners with a criminal record who cannot be deported for technical reasons are to be taken into custody indefinitely until they agree to leave the country.
Scholz and the entire left are fighting this bill tooth and nail. Sadly, they're not without a leg to stand on. I hate to say it, but the last and second-to-last bullet points are likely to be unconstitutional.

A 24y man from West Africa killed a young CDU politician on 14th of January and tried to kill a Ukrainian women on the 24th.


So much for the upholding of jurisdicial principles which do not protect the rule of law but essentially protect murderers for the greater good of abstract laws and sacrificing law abiding citizens for that.

I'm still missing this equation in the public discourse.

It seems a bit like the modern Aztec human sacrifice just we sacrifice randomly so nobody can be upset.

The disproportionate danger they pose justify every investigation, interrogation and in the end the expulsion.

The illegal immigration bill is projected to score a five-vote majority in the Diet right about now. The Scholz administration is going nuts, pulling all kinds of Nazi cards and threatening to ask the Constitutional Court to stop the bill. Two ministers went so far as to throw the liberation of Auschwitz into the mix. Several European nations, led by the caretaker government of Austria, have also announced they'll run to the European Court of Justice citing violations of the Treaty of Lisbon.
 
Makes you almost ponder the possibility to have these f**ks deported to whatever country along with the migrant criminals.
Especially when considering that two recent polls show widespread popular support for that bill (well in excess of 66%). Now, don't get me wrong, I'm not suggesting that politicians should change their opinions like a weather vane in the wind. But we're not talking about some trend flaring up. We're talking about the law being upheld.

Well, yes and no. EU member states can suspend their Schengen obligations by declaring a national security crisis.

The problem from a German perspective is that whilst we're undoubtedly in a state of crisis, it took our politicians many years to find the balls to admit as much. It's a rather weak leg to stand on now. The ECJ would probably ask (and not without reason) how what wasn't a crisis a year or five ago can suddenly be a crisis now.

The pushbacks themselves are an ambiguous issue. Strictly speaking they're illegal, but the transit countries are in violation of the law as well if they do not stop non-EU-foreigners from moving from one country into another. Only EU citizens enjoy freedom of movement within the EU.

An Afghan refugee that's entered the EU via Bulgaria has to stay in Bulgaria until his request for asylum has been processed, and the Bulgarians have to stop him from leaving Bulgaria. If he leaves Bulgaria illegally and shows up in, say, Austria, it's upon the Austrians to detain him and send him back to Bulgaria.

It is, and what wordy muck just said is accurate just as much for France too.

Right or wrong, whether we like it or not, the death penalty, martial law or military conscription was “abolished”, or suspended.

In a case of crisis in which Western Europe is, because of uncontrolled immigration, crimes, turning to narcostates slowly but surely things could be reversed but I’m not betting my little possessions on it. Weak politicians, more interested in keeping the status quo and trying to keep our general democracies somewhat peaceful in fear of unrest if things ever change.

It’s a bit of a Trojan horse silly situation. Europe is in great troubles and doesn’t have one bit of a solution right now.

Ironically, the biggest problem in this regard is the EU is not what its critics claim it to be: a centralised government (let alone some form of dictatorship). There's no cohesion, no common course, and that's the problem.

We're getting nowhere migration-wise because each member state has a different position. They're all pulling into different directions.

Some (like Germany and Spain) encourage migration for economical or ideological reasons.
Others (like Hungary) oppose migration but likewise F*** the community over by facilitating illegal transit.

(I mean, the Hungarians literally herd all illegal immigrants they catch onto buses and drop them off at the Austrian border. Kind of invalidates their criticism of the richer countries acting as illegal immigration magnets if the illegals perceive Hungary's police as a shuttle service.)

And many of the border states (like Bulgaria) are not fiscally affluent enough to secure the EU's borders, but they also don't want to hand the keys over to Frontex for reasons of national prestige.

Too many cooks spoil the broth.

Only demented politicians would believe that would end.
EU should never have been created. We should have been satisfied with the EEC
 
I think the contrary is needed. It is in our common interest to control the borders.

And I think the biggest issue is that nobody wants this mess but doesn't want to be the bad guy.

It was really unfair to leave the border countries on their own.

A restrictive measure coupled with an effective system to bring willing workers and keep illegal migration as little as possible.

Problem are the dogooders and their mitläufer blocking everything but closing eyes to the problems as everything can be solved by throwing taxes at it.
 
A sick patient can only remain on palliative care for so long.

But as long as the disease can be hidden, all is good.

However, without proper care the patient will die of the illness.

The Greens and Social Democrats are literally screaming on the floor right now. I'm not even kidding.

Huh, rather mild all things considered.

The "Stand up to fascism! We'll go on the barricades!" is funny though. Very romantic and idealist.

Everybody is talking about doing barricades stuff until it is actually time to do barricades stuff. :D
