Because National Guard units are not just under the authority of the federal government, but also controlled and maintained by the individual states. The National Guard is a continuation of the militias maintained since Revolutionary times. Since 1903 the National Guard has had a national (federal) status and since 1933 can be under the authority of either the state government, federal government or both. Before 1903 militia members were called up for service in federal units. After that they served in their own units or units could be converted to regular army units for the duration of a war. The exception was the Vietnam war mainly due to political considerations.
