He was off duty when he was shot dead aged 28 by the PIRA while travelling to work in his land rover with his friend, ex UDR, at Lisdoo, Clady, near Strabane, County Tyrone the 10th December 1971 when they were both killed in a machine gun attack. He resided at Castlederg, his friend, resigned from the UDR last July. He had stopped his vehicle in a back road between Clady and Strabane about one mile from Clady to pickup another man. While they were waiting, they were fired at from bushed at the side of the road close to their vehicle. Sergeant Smyth tried to escape by getting out of his vehicle and as a laid on the ground he was riddled with bullets. The third man the police said was close to the scene but threw himself to the ground and escaped unhurt. Sergeant Smyth had been in the habit of collecting the third man at the same point.
